1.1 We may revise our terms and conditions at any time. It is advised that you check on our website here from time to time in order to familiarise yourself with any changes as they are binding to you. If you do not wish to accept our terms and conditions, do not use the website.

2.1 An order is placed with us when you complete the online checkout process and make payment via our third party payment gateway. Please check your details and order carefully for any errors. An order acknowledgement will be sent to you via email. If any of these details are incorrect, please contact us immediately at hello@seatherny.co.uk advising us of the errors. Items ordered in error and incorrect contact details and delivery information will be your responsibility and could incur charges to rectify.
2.2 After your purchase, we will contact you to discuss access requirements to your property. Please be aware that if specialist equipment (such as cranes or lifting equipment) is necessary to deliver your hot tub, this will be your responsibility to arrange at your own expense. We are happy to discuss this directly with your appointed contactor.
2.3 We will endeavour to deliver all stock items within two weeks, and after confirmation of the correct pre-installation requirements. On occasion, due to circumstances out of our control, delivery and installation could take longer. Speak to us prior to your purchase if you require delivery by a specified time and where possible, we will do everything we can to meet your needs.
2.4 We reserve the right to refuse acceptance of any orders where:
a) we cannot obtain authorisation of payment
b) if a pricing or product description error is identified
c) products or services ordered become unavailable
d) delivery to your area has not been confirmed or agreed prior to ordering
e) you fail to meet the eligibility criteria set out in these terms and conditions
2.5 If payment has already been taken and we decide not to accept the order based on any of the criteria stated above, we will refund any monies owed to you to your payment card as soon as possible. Please be aware that on some occasions, this can take up to 30 days. We will not pay any additional compensation to you for disappointment caused in this instance.
2.6 Acceptance of the order takes place on despatch of the goods and the confirmation we send you pertaining to this despatch.
3.1 All prices shown on www.seatherny.co.uk are inclusive of VAT (where applicable).
4.1 Free delivery of all hot tubs and swim spas providing the delivery is within a 100 mile radius of our Northern Depot in Chesterfield. If the delivery address falls outside this area, the delivery cost is charged at £1.20 per mile and is calculated at the checkout.
4.2 As stated in point 2.3, we will endeavour to make delivery of your items within two weeks. Any unforeseen delays will be discussed with you. Please speak to us BEFORE placing an order if you require items for a particular date and we will do our best to accommodate you.
4.3 If you receive items in error, please contact us at hello@seatherny.co.uk immediately upon receipt and we will rectify this for you. We cannot accept liability for items received in error if we are not notified within 48 hours in writing.
4.4 In the unlikely event that your order arrives damaged, please contact us within 48 hours so that we can rectify the issue for you. Let us know in detail, the nature of the damage and include any photographic evidence if applicable. In this instance, a repair or partial refund will be agreed depending on the nature of the damage. Please note, damage to the step, cover or skirt will only warrant return if the items are unused.
4.4 To organise a return, please contact us directly on hello@seatherny.co.uk stating the reason for the return along with any evidence supporting your request. Please provide full details of the damage/fault and we will advise on the next steps to get this sorted for you.
5.1 We must be contacted in writing if you do not receive any goods ordered by you within 60 days of purchase. We will have no liability to you unless you notify us within 10 days of our maximum delivery period of 60 days from the date on which your ordered the goods.
5.2 If we are notified in writing of a problem relating to this condition, our only obligation will be to
a) rectify and shortage or non-delivery
b) replace or repair damaged or defective goods
c) refund you for the amount you paid to your original payment method
5.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 5.2 above.
5.4 Nothing in these terms and conditions is intended to limit any rights you have as a consumer under applicable law or other statutory rights that may be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
6.1 If you wish to cancel your order, you must notify us at hello@seatherny.co.uk BEFORE we have despatched the goods to you.
6.2 If we have already despatched items to you, Seatherny will accept any returns within 14 days of receipt. A full refund will be issued within 7 working days following receipt of the goods back to us. Return postage & packing will be deducted from the refund amount unless this has been organised directly with a carrier of your choice. If the original packaging is not also returned, a repackaging fee will also be deducted from the refund along with a cleaning and sanitising fee. This will be confirmed to you at the point collection is arranged. It is advisable that prior to any return, you take photographs of the item in case any damage occurs during transit back to Seatherny Please contact us on hello@seatherny.co.uk should you wish to organise a return.
6.3 The rights to return goods as referred to in clause 6.2 will not apply if:
a) the product has already been used
b) the product is one that has been customised to your individual requirements.
The provisions of this clause do not affect your statutory rights.
6.4 All customisable products ordered by us will require a deposit. Cancellations to customisable products will forfeit the deposit as this contributes to materials and workmanship of the spa which will be in production at the point the deposit is taken.
7.1 You are permitted to print and download extracts from this website, including the downloadable technical sheets found on the product pages for private use, providing:
No documents or images are modified in any way
No images on this website are used separately from accompanying text

Had a great service from this company. Arrived on time, great hot tub and answered any later questions very quickly. We run an air bnb Hillcot Glamping and the hot tub has been a huge hit for wonderful star gazing. It is taking a lot of use and still looks good and works well.
